Why this matters to The Ratchet: every click of the control grid sits on a legal scaffolding. The surveillance state needs OLC memos. The Flagging Machine needs DOJ NSD liaisons. The judicial pipeline that ratifies all of it needs the Federalist Society. The control grid’s legal substrate is run by a small recurring cohort. This dossier names them and documents the revolving door they walk through.

The Federalist Society pipeline

Founded 1982 at Yale Law / U Chicago Law. Function: identify, credential, and slot conservative legal talent into Republican administrations, then into the federal judiciary, then SCOTUS. Documented institutionally — the Society publishes its membership criteria, its annual gala, and its co-founder list.

Key personnel in the dataset:

  • Edwin Meese III — Reagan AG 1985-88 → Heritage Foundation Ronald Reagan Distinguished Fellow. Architect of the conservative-legal-movement infrastructure during his AG tenure (DOJ Office of Legal Policy expansion; Bork nomination strategy; OLC memo authority assertion).
  • Leonard Leo — Federalist Society Executive VP 1991-2020; Co-Chair 2020-. Marble Freedom Trust trustee and chairman (a 501(c)(4) organized as a trust, Utah 2020, that received a ~$1.6B gift from Barre Seid — disclosed via tax records obtained by ProPublica/NYT in August 2022 and the trust’s Form 990). Coordinated the Trump1 judicial nominations including Gorsuch, Kavanaugh, Barrett.
  • Eugene Scalia — Gibson Dunn → DOL Solicitor (Bush2) → Gibson Dunn → Sec Labor (Trump1) → Gibson Dunn. Antonin Scalia’s son. Federalist Society affiliation documented.
  • Don McGahn — Jones Day → FEC Commissioner 2008-13 → Jones Day → WH Counsel (Trump1, ran the judicial-nomination apparatus in coordination with Leo’s Federalist Society shortlists) → Jones Day.

The OLC torture/surveillance memo lineage (Click 14-16 substrate)

The Office of Legal Counsel writes binding executive-branch legal opinions. The Bush2 OLC authored the legal architecture for warrantless surveillance, enhanced interrogation, and indefinite detention. These memos were FOIA-released across the Bush2 → Obama transition.

  • John Yoo — OLC Deputy AAG 2001-03 → UC Berkeley Law professor + AEI Visiting Scholar. Authored the warrantless surveillance memo (DOJ OLC opinions).
  • David Addington — VP Cheney’s chief counsel + Chief of Staff 2001-09; Heritage Foundation VP. Coordinated the surveillance/interrogation legal framework from the VP side (per the Goldsmith memoirs + Senate Intelligence Committee 2014 Torture Report).
  • Jay Bybee — OLC AAG 2001-03, signed the original “torture memo” → Ninth Circuit Court of Appeals 2003–present (senior status since Dec 31, 2019; Bush2 appointee).
  • Steven Bradbury — OLC AAG 2005-09; Trump1 DOT General Counsel.

Pattern: legal-substrate authors of clicks 14 (Tap), 15 (Watchers), 16 (Backdoor) rotated into academic and judicial positions where their authorship continued shaping doctrine.

The conservative-money apparatus

Three institutional vehicles fund the apparatus, each documented in IRS Form 990 filings:

  • Heritage Foundation — policy + personnel. Provides the “next conservative administration” personnel binder (Project 2025 is the latest iteration).
  • Marble Freedom Trust — the 501(c)(4) trust (Utah, 2020) that received Leonard Leo’s ~$1.6B from Barre Seid; amount and trustees disclosed via ProPublica/NYT tax records (Aug 2022) and Form 990 — not a FARA registrant (it is a domestic 501(c)(4), not a foreign agent). Funds the Federalist Society Network and adjacent 501(c)(4)s.
  • Federalist Society — credential + network. Membership and chapter rosters are public.

The framing here is deliberate: foundations in, “shadowy donor network” framing out. The funding is publicly documented, and the people who direct it are publicly named.

DOJ National Security Division (Click 1 Flagging substrate)

DOJ NSD was created in 2006 to consolidate national-security-related DOJ functions. Its leadership ran the FBI → DOJ → Big Tech content moderation coordination that the Twitter Files documented.

  • Lisa Monaco — DOJ NSD AAG → WH Homeland Security and Counterterrorism Advisor 2013-17 → NYU Law → Deputy AG (Biden) 2021-25. Pipeline play.
  • Mary McCord — DOJ NSD Principal Deputy AAG → Acting AAG for National Security 2016-17 → Georgetown Law Institute for Constitutional Advocacy and Protection Executive Director 2017-. ICAP has been a major voice in domestic-extremism doctrine and content-moderation legal architecture.
  • James Baker — FBI General Counsel 2014-18 → Brookings → Twitter Deputy General Counsel 2020-22 (was on the Hunter Biden laptop decision chain per Twitter Files Part 7).

Pattern: DOJ NSD → academic/Trust-and-Safety NGO → coordinated with platforms on content moderation. The single cleanest example of the Flagging Machine click being legally operationalized.

  • Merrick Garland — DC Circuit Chief Judge 2013-20 → US AG (Biden) 2021-25. Issued the October 2021 memo directing FBI to investigate threats against school board members, which the School Boards letter framed in “domestic terrorism” terms. The memo and the subsequent NSBA letter retraction are documented public record.
  • Sally Yates — Deputy AG → Acting AG (fired by Trump Jan 2017) → King & Spalding.

Special counsel pipeline

The “independent prosecutor” device gets repurposed by both administrations as the investigative arm against political opposition.

  • Robert Mueller — DOJ → WilmerHale → FBI Director 2001-13 → WilmerHale → Special Counsel 2017-19. Pattern named in the dataset as backstop.
  • John Durham — Special Counsel investigating Crossfire Hurricane 2020-23 (final report May 2023).
  • Jack Smith — DOJ Public Integrity → Kosovo Specialist Chambers (The Hague) Specialist Prosecutor 2018-22 → US Special Counsel 2022-25 (Trump prosecutions).
  • Andrew Weissmann — DOJ Criminal Division Fraud Section Chief → Mueller Special Counsel team Lead Prosecutor → NYU Law.

Pattern: career-DOJ prosecutors get appointed as Special Counsel to investigate the opposing party’s principals; afterward rotate to elite law schools or media commentary. The pipeline is the same for the Mueller and Durham/Smith generations, just inverted in target.

3. The BigLaw Carousel (DOJ ↔ BigLaw ↔ DOJ)

Major firms with documented revolving-door personnel: the dataset already tracks edges from named persons to each. The firms themselves serve as the operational substrate.

Conservative-leaning rotation (firms that produced Trump1/Trump2 cabinet

  • judiciary):
  • Jones Day — Don McGahn (Trump1 WH Counsel), Noel Francisco (Trump1 SG), Heather Wagner (DOJ Civil Division → Jones Day partner).
  • Gibson Dunn — Theodore Olson (Bush2 SG, Bush v. Gore), Eugene Scalia (Trump1 DOL).
  • Kirkland & Ellis — William Barr (Bush1 AG → Kirkland → Trump1 AG → Kirkland), Rod Rosenstein (DAG → Kirkland).
  • Sullivan & Cromwell — historic Dulles-era pipeline; ongoing.

Democratic-leaning rotation (firms that produced Obama/Biden cabinet):

  • Perkins Coie — Marc Elias (Democratic campaigns counsel), Michael Sussmann (indicted 2021, acquitted 2022 per court record), Robert Bauer (Obama WH Counsel).
  • Covington & Burling — Eric Holder (DOJ → Covington → AG → Covington), Lanny Breuer (DOJ Criminal Division Chief → Covington), Brad Smith (Microsoft GC era).
  • WilmerHale — Robert Mueller, Jamie Gorelick.
  • Munger, Tolles & Olson — Donald Verrilli (Obama SG → Munger Tolles).
  • King & Spalding — Sally Yates (post-firing).

Pattern (backstop play): senior-DOJ legal officer → BigLaw partner → senior-DOJ legal officer. Firms profit from the rotation in both directions (client representation needs ex-DOJ insiders; ex-DOJ insiders profit at the firms).

The Solicitor General office (judicial-policy pipeline)

The SG argues the federal government’s cases before SCOTUS. The role has become a credentialing tour through which both administrations route talent for eventual judicial elevation or BigLaw partnership.

  • Theodore Olson (Bush2) → Gibson Dunn
  • Donald Verrilli (Obama, defended ACA + Obergefell) → Munger Tolles
  • Noel Francisco (Trump1) → Jones Day
  • Elizabeth Prelogar (Biden) → career-OSG track

Pattern (pipeline): SG is a 4-year senior-legal sinecure that nearly always pays out into BigLaw partnership afterward.

4. The Tech General Counsels (Click 1 Flagging + Click 18 Blueprint)

Big Tech’s content-moderation policies and AI-safety lobbying are run by legal staff. The General Counsel/Chief Legal Officer pattern at Microsoft, Google, and Meta is now functionally a co-CEO role with policy reach beyond the firm.

  • Brad Smith — Covington → Microsoft GC 2002-15 → Microsoft President 2015-. Drove the Christchurch Call signatory commitments, the GIFCT founding, and Microsoft’s positioning on EU AI Act.
  • Kent Walker — DOJ Cybercrime → AOL Senior Counsel → eBay → Google GC 2006-18 → Google President of Global Affairs / Chief Legal Officer 2018-.
  • Monika Bickert (Meta VP Content Policy) — DOJ federal prosecutor → Meta. The single most thesis-relevant edge in the dataset: federal prosecutor to platform-content-rules architect.
  • Joel Kaplan — Bush2 WH Deputy Chief of Staff → Meta VP Global Public Policy → Meta Chief Global Affairs Officer 2025-.
  • James Baker — FBI GC → Twitter Deputy GC (already documented above).

Pattern: senior federal-legal experience routes into senior tech policy roles, where Click 1 (Flagging Machine) is operationally implemented at platform scale.
